AML & KYC Policy

This policy is issued by EarnLab Limited, a company incorporated under the laws of Malta, whose registered office is at Elite Business Centre, Trejqa ta' Box Box, Msida MSD1840, Malta, with a company registration number C105654.

1. Compliance Framework

Our AML/CTF procedures are designed to meet both international and local obligations. They are based on:

  • FATF Recommendations on Anti-Money Laundering and Counter-Terrorist Financing
  • EU AML Directives (including Directive 2015/849 and subsequent amendments)
  • The Prevention of Money Laundering Act (Cap. 373, Malta)
  • The Maltese Criminal Code (Cap. 9) on terrorist financing
  • The FIAU’s Implementing Procedures
  • EU restrictive measures and international sanctions

2. Internal Controls and Restrictions

  • Earnlab does not support transactions involving physical cash.
  • Accounts may not be used by third parties or shared among multiple users.
  • We may request identification documents from users whose activity is flagged as suspicious.
  • Peer-to-peer transfers on our platform are prohibited.
  • We may delay, reject, or investigate transactions that raise suspicion.
  • Suspicious activities may be reported to competent authorities without prior notification.

3. Identity Verification (KYC)

Our Know-Your-Customer (KYC) program uses adaptive verification procedures based on risk level. We authenticate user identities and monitor for illicit activity in line with international standards and Maltese regulatory expectations.

Users deemed higher risk — such as Politically Exposed Persons (PEPs), users from high-risk jurisdictions, or users flagged for unusual behavior — are subject to Enhanced Due Diligence (EDD). If verification is not completed when requested, access may be restricted or terminated.


4. Documents We May Request

When a user's activity is considered suspicious or meets enhanced due diligence criteria, we may require the submission of:

  • Legal name and birthdate
  • Proof of residence
  • Government-issued photo ID
  • Recent utility bill or official address confirmation
  • A photo/selfie holding your ID
  • Additional details about your source of funds and transaction purpose

Where required, documentation may need to be certified or notarised as per applicable regulatory standards.


5. Your Responsibility as a User

  • Confirm that your activity is legitimate and in compliance with applicable laws.
  • Acknowledge that we may disclose account information to authorities in case of suspicion or as required by law.

6. Restricted Activities

  • Cryptocurrency mixers or anonymizing services
  • Businesses or individuals classified as high-risk under international or Maltese AML frameworks

7. Ongoing Surveillance and Reporting

Earnlab continuously monitors platform activity. Unusual behavior may result in the submission of Suspicious Transaction Reports (STRs) to the appropriate authority (e.g., FIAU in Malta).

Users may report concerning activity by emailing: compliance@earnlab.com. Reports are handled confidentially and investigated accordingly.


8. Adherence to Sanctions

We comply with international sanctions imposed by the EU, UN, US OFAC, UK OFSI, and other recognized authorities. Access is denied to sanctioned persons and entities, and we notify the relevant regulatory bodies when required.


9. Cooperation with Authorities

We respond to lawful information requests and cooperate with regulatory and enforcement bodies internationally, including but not limited to the FIAU in Malta.


10. Data Confidentiality & Security

User data is securely processed in accordance with the General Data Protection Regulation (GDPR), the Maltese Data Protection Act (Cap. 586), and other applicable data laws. Information is shared only as required by law or to combat financial crime.
