These Giveaway Terms and Conditions (“Giveaway T&C's”) govern your participation in any giveaways, competitions, or prize promotions (“Giveaways”) organised by or on behalf of EarnLab.
By participating in any Giveaway, creating an EarnLab account, or using the Platform in any way related to a Giveaway, you agree to be bound by these Giveaway T&C's in addition to EarnLab's main Terms of Service (available at https://earnlab.com/terms) and Privacy Policy (available at https://earnlab.com/privacy). In the event of any conflict, these Giveaway T&C's shall prevail solely in relation to the Giveaway(s).
EarnLab reserves the right to amend these Giveaway T&C's at any time. Continued participation after any changes constitutes your acceptance of the updated terms.
1. GENERAL
1.1 This Site (as defined herein) is managed by EarnLab Limited, a company duly registered in Malta, bearing company registration number C 105654 (hereinafter the ‘Company’, ‘we’, ‘EarnLab’ or ‘us’). The registered office of the Company is at Elite Business Centre, Trejqa ta’ Box Box, Msida MSD 1840, Malta.
1.2 Participation in any Giveaway is voluntary and free of charge (no purchase or payment is necessary).
1.3 These Giveaway T&C's form part of the binding contract between you and EarnLab and must be read together with the main Terms of Service.
2. DEFINITIONS
In addition to the definitions in the main Terms of Service:
- “Account” means your registered EarnLab user account.
- “Announcement” means the date and time when the winner(s) of a Giveaway are publicly announced or notified.
- “Supported Country” means any country or territory where EarnLab services are legally offered and available (as determined and updated by us from time to time).
- “Prize” means the item, credit, skin, cash equivalent or other reward offered in a Giveaway.
3. ELIGIBILITY
3.1 To be eligible to participate in any Giveaway and/or claim any Prize you must: (a) have a valid, active EarnLab Account that was created before the Announcement of the relevant Giveaway; (b) reside in a Supported Country where EarnLab services are available; (c) be of legal age (at least 18 years old or the age of majority in your jurisdiction, whichever is higher) and fully capable of entering into a binding contract; (d) comply fully with EarnLab’s main Terms of Service and all applicable laws; and (e) not be on any self-exclusion list or otherwise prohibited from using the Platform.
3.2 Employees, officers, directors, agents, and immediate family members of EarnLab or any of its affiliates, partners, or agencies involved in the Giveaway are not eligible.
3.3 Legitimate accounts only. Accounts created solely or primarily for the purpose of claiming a Giveaway Prize may be disqualified at our sole discretion. Accounts with no platform activity, suspicious behaviour, or any fraud indicators may also be excluded.
4. PARTICIPATION AND ENTRY
4.1 Entry methods will be clearly stated for each individual Giveaway (e.g., social media actions, in-platform actions, etc.).
4.2 We may limit the number of entries per person or per Account. Automated entries, bots, scripts, or any form of artificial participation are strictly prohibited.
5. WINNER SELECTION AND NOTIFICATION
5.1 Winners will be selected in accordance with the rules published for each specific Giveaway (random draw or other fair method as stated).
5.2 We reserve the absolute right to select winners using any method we deem fair and appropriate.
5.3 Winners will be notified via the email address linked to their Account and/or via public announcement. If a winner cannot be contacted within 48 hours or fails to respond and verify their eligibility, the Prize may be forfeited and awarded to an alternative winner.
6. PRIZES
6.1 Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash unless explicitly stated.
6.2 All Prizes are subject to availability. We reserve the right to substitute any Prize with one of equal or greater value.
6.3 Delivery of physical Prizes or digital credits will be made in accordance with our Rewards policy in the main Terms of Service.
6.4 You are solely responsible for any taxes, duties, or other governmental charges arising from the receipt or use of any Prize.
7. DISQUALIFICATION AND ANTI-FRAUD MEASURES
7.1 EarnLab reserves the unrestricted right to disqualify any participant or void any entry if we reasonably believe that:
- the participant has used multiple Accounts;
- the participant has used fake identities, stolen data, or provided false information;
- the participant has attempted to manipulate, tamper with, or unfairly influence the Giveaway;
- the participant has participated through automated systems, bots, scripts, or bot networks;
- the participant is identified as part of any giveaway-farming community or is engaging in coordinated abuse;
- the Account shows suspicious behaviour, lack of genuine platform activity, or any other fraud indicator.
7.2 We may at any time require participants to:
- complete basic platform activity;
- verify their identity, address, or Account;
- comply with our anti-fraud and anti-money-laundering policies.
7.3 Our decision regarding disqualification is final and binding. No correspondence will be entered into.
8. ADDITIONAL RULES PER GIVEAWAY
8.1 Specific additional rules (e.g., minimum earnings, country restrictions, activity thresholds, or entry limits) may be published for individual Giveaways. Those rules form part of these Giveaway T&C's and take precedence where they conflict.
8.2 We may run targeted or smaller follow-up Giveaways with stricter rules to reward genuine users.
9. DATA PROTECTION AND PUBLICITY
9.1 By participating you consent to us using your username, name, country, and any submitted content for promotional purposes, including on social media and the Platform.
9.2 Your personal data will be processed in accordance with our Privacy Policy.
10. ADDITIONAL WARRANTIES AND DISCLAIMERS
10.1 The Giveaway and all Prizes are provided “as is” without any warranties, express or implied.
10.2 We do not guarantee that the Platform or any Giveaway will be error-free, uninterrupted, or free from manipulation.
10.3 To the maximum extent permitted by law, EarnLab, its officers, directors, employees, and agents shall not be liable for any loss, damage, or injury arising from your participation in any Giveaway, including (but not limited to) technical failures, unauthorised access, or Prize delivery issues.
11. LIMITATION OF LIABILITY
11.1 Our total liability to you in connection with any Giveaway shall not exceed €1,000 (one thousand Euros).
11.2 We shall not be liable for any indirect, consequential, or punitive damages.
12. INDEMNITY
You agree to indemnify and hold harmless EarnLab, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with your participation in any Giveaway or any breach of these Giveaway T&C's.
13. TERMINATION AND SUSPENSION
We reserve the right to cancel, suspend, or modify any Giveaway at any time without prior notice and without liability.
14. GOVERNING LAW
14.1 These Giveaway T&C's shall be governed by and construed in accordance with the laws of Malta.
14.2 You irrevocably submit to the exclusive jurisdiction of the Courts of Malta for the resolution of any dispute arising out of or in connection with these Giveaway T&C's.
15. MISCELLANEOUS
15.1 If any provision of these Giveaway T&C's is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15.2 No waiver by us of any breach shall constitute a waiver of any subsequent breach.
15.3 These Giveaway T&C's, together with the main Terms of Service and Privacy Policy, constitute the entire agreement between you and EarnLab regarding Giveaways.
By participating in any EarnLab Giveaway you confirm that you have read, understood, and agree to these Giveaway Terms and Conditions.
